The Chief Justice of India (CJI), Sharad Arvind Bobde, said on Friday that “if death is imminent bail will make no difference”, the Bar and Bench reported.
The Bar and Bench, an online portal dedicated to Indian legal news, reported that the CJI-led bench was hearing a man’s bail plea and his advocate had sought bail on the health grounds, saying, “He has a kidney failure.”
“If he dies then he will die when he is out on bail too. Everyone is dying,” said the CJI. “What can we do?”
The advocate argued that “there is lack of medical treatment”, to which the CJI replied: “That we can provide … if death is imminent bail will make no difference.”
The apex court directed medical care for the applicant in jail and asked authorities to ensure necessary treatment.
