Police in Kashmir arrests 16-year-old boy under PSA

Photograph by Shahid TantrayTerming the claims of the Jammu and Kashmir government that no minor is in police lock up and no Public Safety Act (PSA) has been slapped on any teenager as white lie the Hazratbal family Wednesday claimed that their 16-year-old son has been booked under PSA by the authorities.

The copies of date of birth and Public Safety order lying with the news agency (CNS) clearly shows that the government has slapped PSA on a minor identified as Aasif Majeed Shaksaz son of Abdul Majeed Skaksaz resident of Yatoo Mohalla Hazratbal. The school record shows his date birth as April 30, 1997 which indicates that his present age is 15 years 11 months and 3 days.

District Magistrate Srinagar in his letter vide order number DMS/PSA/58/2012 dated 25-3-2013 reads that “after perusal of records submitted by the Senior Superintendent of Police, Srinagar, and after applying my mind carefully and having regard to the requirements of law, I am satisfied that with a view to prevent Aasif Majeed Shaksaz son of Abdul Majeed Skaksaz resident of Yatoo Mohalla Hazratbal from acting in any manner prejudicial to the maintenance of public order, it is necessary to detain the said person under the provisions of J&K Public Safety Act.”

The order further reads that “after verifying the present status of lodgement capacity of Central Jail, Srinagar, which is overcrowded, I District Magistrate Srinagar am constrained to direct the lodgement of detenue at District Jail, Baramulla which I order accordingly.”

The brother of Aasif told the news agency that his brother was picked up by the police when he was returning to home from Habak. “He works at an automobile shop and he was not a stone pelter,” he said.

Police while giving his grounds of detention has depicted his age as 19 years approximately and has mentioned in its order that Aasif has frequently come in the adverse notice of the police for his involvement in anti-social activities aimed at disturbing the public tranquility and peace in the city.

Police in its records have claimed that Aasif is threat to peace and involved in almost all the stone-pelting incidents which have taken place in the jurisdication of Police Station Zakoora, since last three years either directly or indirectly. “He has been specifically identified as an accused person in case FIR No. 15/2013 under section 188,147,148,149,336,353,427 RPC of Police Station Zakura,” police record maintains.
